I refer to the copy of an email sent to this office on 20 May 2010.
The Australian Human Rights Commission has a specific jurisdiction when it comes to the issues it can deal with. Its role is to consider complaints of less favourable treatment on the basis of a person's race, sex, age or disability within specific areas of public life. The Commission can also investigate complaints of human rights breaches relating to one of the international covenants scheduled to the Australian Human Rights Commission Act 1986, which can only be made against the Australian government.
I note that your email to the Hon Linda Burney expresses concerns about the management of children who are under the care of the Department of Community Services (DoCS). Having considered the issues that you raise, it does not appear that we can assist you, as your concerns do not appear to raise a claim under our jurisdiction as set out above.
As it appears that you have raised these concerns with the NSW Minister for Community Services, it may be more appropriate to await her response. I also note that you have raised your concerns with the NSW Ombudsman, who is generally the more appropriate body to consider claims against NSW Government bodies.
