The form of the Court Attendance Notice
Under the Rules the Chief Magistrate may approve prescribed forms. It is anticipated that there will be two slightly different CAN forms; one for police and public officers and one for private prosecutions. Each CAN will have at least three copies:
1. Bench Copy
2. Defendant Copy
3. Defendant Copy with statement of service
The Bench Copy of the CAN will contain one offence for each notice. The Defendant Copy and the Defendant Copy with the statement of service will allow for multiple offences on that notice.
When a CAN is filed after service the Court Registry will receive the Bench Copy as well as the Defendant Copy with a statement of service.
The format of the CAN have yet to be approved by the Chief Magistrate.
