If you have had your beautiful newborn baby stolen from the arms of you whilst in hospital, or anywhere for that matter and they do not have a court order, then guess what? It IS KIDNAP. And if it is done with more than one person, and it generally is, then it is aggravated kidnap - Penalty 20 YEARS.
The Crimes Act 1900 - Section 86 - Kidnapping - states "A person who takes or detains a person, without the person’s consent, with the intention of holding the person to ransom, or with the intention of obtaining any other advantage, is liable to imprisonment for 14 years. And for an "Aggravated Offence" - A person is guilty of an offence under this subsection if the person commits an offence in the company of another person or persons.
Furthermore it also states : A person who takes or detains a child does not commit an offence under this section if the person is the parent of the child or is acting with the consent of a parent of the child, and the person is not acting in contravention of any order of a court relating to the child. This currently means that if they remove your children without a prior court order first then it is kidnap and it is a punishable offence under the Crimes Act. Click to View
